Terms and conditions

Using this website, and the terms on which we quote, manufacture, deliver and install.

Part A. Using this website

Content

The text, photographs, drawings and layout on lenopergola.ie belong to us or are used with permission. You may look at them, print a copy for your own use and share a link. You may not republish, sell or use them commercially without our written agreement.

Accuracy

We keep the site as accurate as we can, but specifications, colours and prices change. Nothing on the site is an offer. A price only becomes binding when we put it in a written quotation after a survey.

Availability

We do not promise the site will always be available or free of faults, and we may change or withdraw any part of it without notice.

Links

Where we link to another site we are not responsible for what is on it.

Part B. Buying from us

Quotations

A written quotation is valid for 30 days unless it says otherwise. It is based on what we saw and measured at the survey. If conditions on site turn out to differ from that, we will tell you before doing the work and agree any change in writing.

Placing an order

An order is confirmed when you sign the quotation and pay the deposit of [DEPOSIT %]. The balance falls due [BALANCE TERMS]. We start manufacture once the deposit clears.

Lead times

Manufacturing lead times quoted to you are estimates given in good faith, normally four to six weeks. They are not guaranteed dates and we are not liable for a delay caused by something outside our control, including weather, a supplier failure or a delay in getting access to the site.

Your responsibilities before installation

  • Clear and safe access for our team and materials on the agreed day.
  • A solid, level base or foundation where one is required, unless we quoted for it.
  • A working power supply within reach if the structure has motors or lighting, unless we quoted for the electrical work.
  • Telling us about anything buried where we are fixing: pipes, cables, drains, a septic system.

If we arrive and cannot work because one of these is not in place, we may charge a return visit at [CALLOUT RATE].

Planning permission

Getting any permission needed is your responsibility. Most rear-garden structures in Ireland are exempt from planning permission, but the exemption depends on size, height, the distance to a boundary and how much of your garden is already covered. We will tell you what we think at the survey. That is our opinion and not a certification, and it does not transfer the responsibility to us.

Risk and title

Risk in the goods passes to you on delivery to the site. Ownership stays with us until we have been paid in full.

Warranty

We guarantee the aluminium frame and its powder-coated finish against manufacturing defects for 10 years from installation. Moving parts, motors, remote controls and lighting are guaranteed for [X] years. The warranty covers repair or replacement of the defective part and our labour to fit it.

It does not cover: normal wear; damage from an impact, an accident or a storm beyond the wind load the structure was specified for; damage caused by anyone altering, extending or moving the structure; corrosion caused by contact with another metal or by cleaning products we did not recommend; or a failure caused by the base or fixings where those were not supplied by us.

The warranty is in addition to your rights under the Sale of Goods and Supply of Services Act 1980 and the Consumer Rights Act 2022. Nothing here limits those rights.

Cancellation

Where you order at a distance or away from our premises, you normally have 14 days to cancel without giving a reason under the European Union (Consumer Information, Cancellation and Other Rights) Regulations 2013.

That right does not apply to goods made to your measurements or clearly personalised. Almost everything we make is cut to the size of your garden, so once manufacture has started the order cannot be cancelled. Stock parts and unopened self-build kits bought from the shop can be returned within 14 days in their original condition, and you pay the return carriage.

If something goes wrong

Tell us. Write to [email protected] or phone 041 987 8462 or 085 726 1879 with your order number and a photograph if there is something to see. We acknowledge within 2 working days and tell you what we intend to do within 10.

Liability

We do not exclude or limit our liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot lawfully be excluded. Subject to that, our liability in connection with an order is limited to the price you paid for it, and we are not liable for loss of profit, loss of use or any indirect loss.

Governing law

These terms and any contract under them are governed by the law of Ireland, and the Irish courts have jurisdiction.
